1. Scope of application
The following General Terms and Conditions ("GTC") govern the conditions under which the services offered by Molindo GmbH ("Molindo") at www.lyrics.me ("Lyrics.me") can be utilized by users. Molindo is entitled to amend or supplement these General Terms and Conditions (GTC) with reasonable notice. Changes will be announced by publication on the Lyrics.me website. Continued use of the website after publication of the amended GTC constitutes acceptance of the changes.
2. Service description
Lyrics.me is an online service focused on music-related content. It enables users to search for song lyrics and access information about artists. Lyrics.me may expand, modify, or discontinue features or services at any time. Lyrics.me reserves the right to offer new functionalities and services on Lyrics.me or to remove existing functionalities and services at any time. In addition, existing or new services may be offered for a fee with 4 weeks advance notice. Lyrics.me offers its services exclusively for private, non-commercial purposes.
3. Access and Use of the Service
Users may access Lyrics.me without creating an account or providing personal data, except for data automatically transmitted by their device or browser. By using Lyrics.me, users agree to these GTC. If services offered by cooperation partners are integrated or linked, their own GTC may apply. Users must refrain from any action that could impair or disrupt the proper functioning of Lyrics.me, including attempts to interfere with security measures, introduce malware, or overload the service.
4. Prohibited Conduct
Users must not: interfere with the technical operation of Lyrics.me access or attempt to access areas of the service not intended for public use use automated systems (e.g., bots, scrapers, crawlers) to collect data or interact with the service use Lyrics.me in any way that violates applicable law or infringes on third-party rights attempt to circumvent advertising, tracking mechanisms, or security functions Lyrics.me may block or restrict access for users who violate these prohibitions.
5. Rights of use
Molindo grants users a limited, non-exclusive, non-transferable, revocable right to access and use the publicly available content on Lyrics.me for private, non-commercial purposes. All content available on Lyrics.me - including song lyrics, text elements, images, metadata, and layout - is protected by copyright and other intellectual property rights. Users may not reproduce, distribute, publicly display, modify, or otherwise use content beyond what is permitted by law. Any automated extraction, archiving, or republication of content is strictly prohibited.
6. Prices and payment for paid services
Lyrics.me offers its services free of charge. Lyrics.me is entitled to offer special services for a fee in the future. Users will be informed in advance should such features be introduced. Until then, no fees are charged.
7. Warranty
Lyrics.me provides its services in the form and scope deemed appropriate by Molindo and may modify, interrupt, or discontinue them at any time. Users access and use Lyrics.me at their own risk. This particularly applies to the downloading or use of content, including third-party content. Users are solely responsible for any damage to their devices, loss of data, or harm caused to third parties resulting from such use. Lyrics.me does not warrant that the service will meet users’ expectations or be available without interruption, securely, or error-free. No warranty is given regarding the accuracy or reliability of information provided through the service.
8. Third party rights
Lyrics.me integrates content provided by third parties (e.g., YouTube, Spotify, Musixmatch, social media platforms). Molindo has no influence over third-party content and assumes no liability for such content. Providers of third-party platforms are solely responsible for the content displayed through their services. Users must comply with applicable third-party terms of service and privacy policies. Molindo does not guarantee the continued availability of third-party content and may remove or replace such content at any time.
9. Liability
Lyrics.me is liable for damages only where caused intentionally or by gross negligence. In cases of slight negligence, Lyrics.me is liable only for breaches of essential contractual obligations (“cardinal obligations”), and only for foreseeable damages. Furthermore, Lyrics.me is liable for damages according to the Product Liability Act as well as for damages due to injury to life, body or health. The defense of contributory negligence on the part of the user remains unaffected by Lyrics.me. The above limitations of liability also apply to breaches of duty by legal representatives or vicarious agents of Lyrics.me. Lyrics.me expressly distances itself from the content of all pages to which direct or indirect references (so-called "links") exist from the Lyrics.me website. Lyrics.me assumes no liability for these contents and pages. The providers of the respective pages are responsible for the content of these pages.
10. Notices of infringement
Lyrics.me respects the intellectual property of others and asks its users to do the same. If anyone believes that their copyrights have been infringed by content on Lyrics.me, they are requested to contact us using the following information: a description of the copyrighted work that is allegedly infringed a description of where the material that is claimed to be infringing is located an electronic or physical signature of the person authorized to act on behalf of the copyright owner the address, telephone number and e-mail address of the copyright owner a statement that, to the best of your knowledge, the disputed use is not authorized by the copyright owner, its agent, or the law a statement under penalty of perjury that the above information is accurate and that you are the copyright owner or authorized to act on the copyright owner's behalf.
11. Data protection
Personal data will be collected, processed, and used only to the extent necessary to provide the Lyrics.me service and in accordance with applicable legal requirements. Data is collected, used, and processed electronically. Lyrics.me uses plugins from the YouTube platform operated by Google, Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland. YouTube videos are embedded on Lyrics.me, whereby a direct connection to the YouTube servers is established and YouTube is informed which pages the user has visited on Lyrics.me. If a user has a YouTube account and is logged in, this data is assigned to the personal account and the data stored in it. The integration of YouTube is implemented as a YouTube Data API client application. The use of the API client is subject to the YouTube Terms of Service (ToS) and the Google Privacy Policy. For more detailed information on how we process personal data, please refer to our Privacy Policy available on Lyrics.me. The data processing described in this section is carried out in accordance with the GDPR and applicable Austrian data protection laws.
12. Preservation clause (severability clause)
Should individual provisions of these GTC be or become invalid or contradict statutory provisions, the validity of the remaining GTC shall not be affected.
13. Final provisions
Lyrics.me is entitled to transfer all contracts with the user that fall within the scope of these GTC in whole or in part to a third party with discharging effect. The user hereby agrees to such a transfer of contract. In the event that Lyrics.me makes use of this transfer option, the user has the right to terminate the contract without notice. For all legal relationships between Lyrics.me and the user, the laws of the Republic of Austria shall apply exclusively, excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG). If the user does not have a general place of jurisdiction in Austria or in another EU member state, is a merchant, relocates their permanent residence abroad after these GTC come into effect, or if their place of residence or habitual abode is unknown at the time legal proceedings are initiated, the exclusive place of jurisdiction shall be Dornbirn, Austria.
